Terms and conditions

This is a convenience translation. The German version is the legally binding one.

§ 1 Scope and provider

These Terms of Service apply to the Hub account, the paid Personarium membership, and the use of the public Hub at personarium.app. The provider is Fynn-Luca Chilcott, …, … (“we”, “us”). Our offering is directed at consumers who are at least 18 years old. The language of the contract is German; the English version of these pages is a non-binding translation.

§ 2 Services

Free account: The Hub account is free of charge. It enables sign-in, reporting content, and — with an active membership or trial period — the further features. New accounts additionally receive a one-time short free preview of the membership features (currently one day), without any payment details being required.

Membership: The membership includes (a) the right to download and use the Personarium desktop app, (b) updates to the app during the term, (c) downloading published character cards from the Hub, and (d) publishing your own cards on the Hub subject to §§ 8–10.

After a membership ends, the app switches to a read-and-export mode: your local data (characters, chats, media) remains fully preserved, can be viewed, and can be exported at any time; creating and editing content, as well as AI features, require an active membership. The app checks the membership status online at regular intervals and remains fully usable for up to 14 days without contacting the server.

Your own AI keys (Bring Your Own Key): The app’s AI features use services from third-party providers (e.g., OpenRouter, fal.ai) with which you enter into your own contracts and whose costs you bear yourself. These third-party services are not part of our service; their availability, quality, and terms are the responsibility of the respective provider.

Beta access: Free, time-limited test access granted by us provides the membership features without any obligation to pay; it can be ended at any time without giving reasons and does not create any entitlement to continuation.

§ 3 Formation of contract

The membership contract is formed when you complete the order process through our payment provider Stripe by confirming the order with a payment obligation. Before completion, we show you the price, term, and renewal terms. After completion, you receive a contract confirmation by email (§ 312f BGB). You can retrieve and save the contract text (these Terms of Service) here at any time.

§ 4 Prices and payment

The membership costs €4.99 per month or €49.90 per year. As a small business under the small-business exemption in § 19 UStG (German VAT Act), we do not charge VAT; the prices stated are final prices. Payment is processed through Stripe and is due at the start of each billing period. On your first purchase, the membership begins with a one-time, free 14-day trial period; if you do not cancel before it ends, the membership converts into the paid term. If you subscribe again after a previous membership, there is no further trial period; the membership is then billed from the conclusion of the contract — we point this out to you before you complete the order.

§ 5 Term, renewal, cancellation

The membership automatically renews for the respective billing period (month or year) until it is cancelled. You can cancel at any time, effective at the end of the current period — via the “Cancel contracts here” button (no sign-in required) or through the billing management in your account. Periods already paid for remain usable until their end. The right to extraordinary cancellation for good cause remains unaffected. Regardless of this, you can delete your free account at any time in your account settings. If you delete your account while a paid membership is running, the membership is automatically cancelled effective at the end of the current billing period.

§ 6 Right of withdrawal

As a consumer, you have a 14-day right of withdrawal. Details, the model withdrawal form, and the electronic withdrawal function can be found in the withdrawal instructions.

§ 7 Provision and updates

The statutory rules on digital products apply to the membership (§§ 327 ff. BGB, German Civil Code). During the term, we provide the app updates required for conformity with the contract — including security updates — and inform you of them within the app. The Hub is operated with high, but not uninterrupted, availability; brief interruptions for maintenance and updates are possible and, where they can be planned, are scheduled for low-usage times.

§ 8 Rules for published content

The Hub is a platform that is safe-for-work (SFW) at all times. When publishing cards or other contributions, the following is in particular prohibited:

  • sexually explicit, pornographic content, or content oriented toward sexual acts;
  • any depiction of persons or characters who are minors or who appear to be minors; characters must be explicitly and recognizably of legal age;
  • content that infringes the rights of third parties (copyright, trademark, personality rights), including depicting real persons without their consent;
  • third parties’ personal data;
  • unlawful content of any kind, as well as malicious code or content that disrupts the operation of the platform;
  • circumventing the platform’s technical protection and review mechanisms.

You warrant that you hold the necessary rights to everything you publish.

§ 9 Grant of rights in published content

By publishing, you grant us a simple, royalty-free, territorially unrestricted right to use the content — limited to the purposes of operating the platform: storage, technical reproduction, making it publicly available on the Hub, providing it for download to other users for use in the app, moderation, and backups. No further exploitation takes place. The right of use ends when you withdraw the content; downloads already made by other users remain unaffected. At the same time, you grant the users who download your published content via the Hub a simple, royalty-free, non-transferable right to use the content in the Personarium app for their own, non-commercial purposes. When you delete your account, you choose whether your published cards are removed or remain online in anonymized form; in the latter case, the right of use continues to that extent.

§ 10 Moderation, sanctions, reporting procedure

Every piece of content submitted for publication is reviewed before it goes live (by us and/or through automated processes). In the event of violations of § 8 or statutory provisions, we may — depending on severity, repetition, and degree of risk — reject or remove the content, warn you, restrict publishing for a limited time, or suspend your account temporarily or permanently. In the case of serious violations, in particular any violation of the prohibition on depicting minors, permanent suspension may occur without prior warning. For every measure, we provide you with a statement of reasons in text form, at the latest when it takes effect; you can object to it informally at … — we will then review it again. You may additionally refer the matter to an out-of-court dispute settlement body certified under Art. 21 of Regulation (EU) 2022/2065. Anyone can report unlawful content via the report form. Statutory obligations and rights (in particular under Regulation (EU) 2022/2065, the DSA) remain unaffected.

§ 11 Warranty and liability

The statutory warranty law applies (§§ 327 ff. BGB). We are liable without limitation for damages in cases of intent and gross negligence, for injury to life, body, or health, and under the Product Liability Act. In cases of ordinary negligence, we are liable only for the breach of material contractual obligations (obligations whose fulfillment makes the proper performance of the contract possible in the first place, and on whose compliance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.

§ 12 Changes to these Terms

We may amend these Terms of Service with effect for the future where (a) changes in the law or in case law require it, or (b) we introduce new or expanded features and the amendment is necessary for them, without diminishing your existing rights. We will notify you of changes in text form at least four weeks before they take effect; they apply at the earliest from your membership’s next renewal. If you do not agree, you can cancel at any time before then, effective at the end of the current period. Price changes are excluded from this clause: we will announce them separately in text form at least six weeks before they take effect, stating the reason; they only apply to subsequent renewals, and you have the right to cancel effective at the end of the current period at any time before they take effect.

§ 13 Final provisions

German law applies. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG, German Consumer Dispute Resolution Act). Should individual provisions of these Terms of Service be invalid, the remainder of the contract remains valid; the invalid provision is replaced by the applicable statutory provisions.
