Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (Fynn-Luca Chilcott, …, …, phone: …, email: …) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You can use the attached model withdrawal form for this purpose, although it is not mandatory.

You can also withdraw from the contract using the electronic withdrawal function: it is permanently available at the top of this page (personarium.app/widerruf) — the “Withdraw from contract” button. If you exercise your right of withdrawal this way, we will send you a confirmation of receipt of the withdrawal without delay (e.g., by email).

To meet the withdrawal deadline, it is sufficient that you send the notice concerning your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we must repay you all payments we have received from you without delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this repayment, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

If you have requested that performance should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with respect to this contract, compared to the total scope of the services provided for in the contract.

Early expiry of the right of withdrawal

For the membership as a digital service: your right of withdrawal expires once we have fully performed the service, provided we only began performance after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal upon full performance of the contract by us (§ 356 Abs. 5 BGB, German Civil Code). Until then, your right of withdrawal remains — and, where you requested early performance, the pro-rata compensation described in the preceding section applies.

Insofar as individual parts of the service are digital content not supplied on a physical medium (e.g., downloading the app or character cards), the right of withdrawal expires for those parts as soon as we have begun performance, after you have expressly agreed that we may begin before the withdrawal period has expired, and you have confirmed your knowledge that, by giving your consent, you lose your right of withdrawal once performance begins, and we have provided you with this confirmation on a durable medium (§ 356 Abs. 6, § 312f BGB, German Civil Code).
